Do I Qualify to Apply for a Green Card?

To get a Green Card in the US, specific requirements must be met tailored to each visa category. Here's a breakdown.
If you already have an approved immigrant petition and an immigrant visa is available, submit Form I-485 to USCIS. If you don’t have an approved petition yet, check if you’re eligible for concurrent filing. If you’re outside the US, apply for an immigrant visa at a US Consulate abroad for consular processing. If you’re already in the US, apply for permanent resident status through adjustment of status without returning home.

What is a permanent resident?

Eligibility for a Green Card includes family members of US citizens or permanent residents, employment-based applicants, Diversity Visa Lottery winners, asylees and refugees, special immigrant categories, spouses of US citizens, and those qualifying for humanitarian reasons. Additionally, returning residents who have been abroad for an extended period due to unforeseen circumstances can apply. 

It’s important to remember that these prices are just the base costs and may vary depending on what else you need for the process. This can include apostilles, notaries, and document translations.

The cost of applying for a Green Card varies, with general fees including $535 for Form I-130, $1,140 for Form I-485 (plus $85 biometrics fee), $325 for Form DS-260, and $220 for the USCIS Immigrant Fee. Additional costs may involve medical exams, translations, travel, and legal fees. 

Most Green Card holders can apply for US citizenship after five years of continuous residence. Spouses of US citizens can apply after three years, provided they live with their US citizen spouse.
