Judge Moss emphasized that neither the U.S. Constitution nor current immigration law permits the President to unilaterally deny migrants the opportunity to apply for asylum or other forms of humanitarian protection.

As a result, any migrant crossing the U.S. border in search of protection once again has the right to file Form I-589—the official application for political asylum. After submitting the application, migrants can proceed through a complete interview process with USCIS officers, where their evidence of persecution and threats to their lives in their home country will be thoroughly reviewed.

However, it is important to note that this court decision is temporary and will remain in effect until mid-July, at which point the administration may file an appeal. This makes the current period particularly critical for individuals already in the U.S. or planning to cross the border to request asylum.

To avoid potential delays in processing cases, experts advise not postponing the preparation of supporting documents.
